Terms & Conditions
1. Introduction
These Terms & Conditions govern all design, production, and installation services provided by Patterned Design (“we”, “us”, “our”) to the client (“you”, “the client”).
By commissioning work from Patterned Design, you confirm that you have read, understood, and agreed to these Terms & Conditions. These Terms apply to all bespoke artwork, printed wallcoverings, and installation services unless otherwise agreed in writing.
2. Scope of Services
Patterned Design offers the following services, which may be commissioned separately or as a combined package:
Bespoke wallpaper and surface pattern design
Production and printing coordination
Installation coordination or supervision (where agreed)
Each stage is governed by the relevant sections below.
3. Design Services (Bespoke Artwork)
3.1 Bespoke Nature of Work
All designs created by Patterned Design are bespoke and developed specifically for the client’s project. Due to the bespoke nature of the work, design fees are non-refundable once work has commenced.
3.2 Design Brief
The client is responsible for providing a clear design brief, including dimensions, site conditions, intended use, and aesthetic direction. Any changes to the brief after work has begun may result in additional fees and revised timelines.
3.3 Revisions
The design fee includes a defined number of revisions, as outlined in the proposal or quotation. Further revisions, changes in direction, or substantial alterations requested beyond the agreed scope will be charged at an additional rate.
3.4 Approval
Once a design is approved in writing (including approval by email), it is considered final. Patterned Design is not responsible for errors or omissions once final approval has been given.
4. Intellectual Property & Usage Rights
4.1 Ownership
All designs, artwork, and creative materials produced by Patterned Design remain the intellectual property of Patterned Design, unless otherwise agreed in writing.
4.2 Licence to Use
Upon full payment, the client is granted a licence to use the design solely for the agreed project and location. The licence does not permit resale, reproduction, redistribution, or reuse of the design for other projects without prior written consent.
4.3 Portfolio & Promotion
Patterned Design reserves the right to photograph and showcase completed designs and installations for portfolio, website, press, and promotional purposes, unless otherwise agreed in writing.
5. Production & Printing
5.1 Production Coordination
Where Patterned Design coordinates printing or production, this is done using trusted third-party manufacturers. Production timelines are estimates and may vary due to supplier lead times or external factors.
5.2 Colour & Material Variations
Printed colours and materials may vary slightly from on-screen previews or samples due to printing methods, substrates, lighting conditions, and batch differences. Such variations are industry standard and do not constitute defects.
5.3 Samples
Samples are recommended prior to full production. Approval of samples confirms acceptance of colour, scale, and finish.
5.4 Production Errors
Patterned Design is not responsible for errors resulting from incorrect measurements, site conditions, or information supplied by the client or third parties.
6. Installation
6.1 Installation Services
Installation may be arranged, supervised, or recommended by Patterned Design where agreed. Installation services may be carried out by third-party installers.
6.2 Site Readiness
The client is responsible for ensuring that walls and surfaces are suitably prepared for installation. Patterned Design is not liable for installation issues arising from unsuitable substrates, damp, structural defects, or site conditions beyond our control.
6.3 Installation Responsibility
Once installation is complete, responsibility for the condition of the installed wallcovering passes to the client. Patterned Design is not responsible for damage occurring after installation.
7. Fees & Payment
7.1 Fees
All fees are outlined in the agreed quotation or proposal. Prices exclude VAT unless stated otherwise.
7.2 Payment Terms
Invoices must be paid in accordance with the payment schedule stated in the proposal. Work may be paused if payments are overdue.
7.3 Late Payment
Late payments may incur additional charges and may delay production or installation timelines.
8. Cancellations & Termination
8.1 Design Services
Once design work has commenced, fees are non-refundable.
8.2 Production
Production orders cannot be cancelled once printing has begun.
8.3 Installation
Cancellation of installation services may incur costs depending on notice period and third-party commitments.
9. Limitation of Liability
Patterned Design’s liability is limited to the value of the services provided. We are not liable for indirect, consequential, or incidental damages, including loss of profit, delay, or third-party costs.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
